Interactive Terms of Service

General Contract Overview

This contract governs your safari arrangements with **All in Africa Safaris USA LLC** (the booking and contracting entity) and **All in Africa Safaris (U) Ltd** (the ground operator). Please read these terms carefully as they set out our respective obligations. Note that the standards of service, medical facilities, safety, and security in safari countries (**Uganda, Rwanda, Tanzania, Kenya**) may be lower than those in your home country, and the laws of the country where services are provided apply to your holiday arrangements.

All bookings are made through the US entity, but the physical safari services are rendered by the Ugandan entity.

1. Cancellation Policy & Fee Schedule

The most important risk factor for any booking is the cancellation window. This visual guide illustrates the fee levied (as a percentage of the total tour package) based on the number of days before your arrival. **All cancellations must be advised to us in writing.**

Cancellation Fee vs. Time Frame

Fee Percentage (%)

60+ Days (0% Fee)

59–32 Days (25% Fee)

31–15 Days (50% Fee)

14–8 Days (70% Fee)

7 Days or less (100% Fee)

Voluntary Cancellation Fees

The cancellation fee excludes insurance and is levied to cover losses incurred due to the inability to resell your package holiday.

  • **60+ Days** before arrival: **Full Refund (0% Fee)**
  • **59–32 Days** prior to arrival: **25%** of the total tour package
  • **31–15 Days** prior to arrival: **50%** of the total tour package
  • **14–8 Days** prior to arrival: **70%** of the total tour package
  • **7 Days or less** prior to arrival: **100%** of the total tour package

Cancellation by All in Africa Safaris

We reserve the right to cancel bookings for reasons beyond our control (e.g., Force Majeure) or due to failure to make full payment on time. We will not cancel less than 60 days before departure unless unavoidable. In case of cancellation, we will offer an alternative date/package or a full refund (limited to funds received by us, such as available Gorilla permit refunds).

2. Liability, Insurance, and Dangers

Our Liability

We are responsible for ensuring all components of the holiday are supplied to a reasonable standard. Our liability for complaints (excluding death, personal injury, or illness) is limited to the cost paid by the affected person for the applicable services. Liability for luggage loss/damage is compensated up to a maximum of **USD 30**, assuming you hold proper insurance.

This acceptance of responsibility is subject to the **Force Majeure** clause.

Mandatory Insurance & Safety

It is a **MANDATORY REQUIREMENT** that every person arranges personal travel insurance covering injury, death, medical expenses, and theft of personal property. For high-adventure activities (e.g., mountaineering, rafting), the insurance must cover these specific risks.

**Wild Animals:** While in national parks, you must recognize that animals are wild. You are strictly required to respect local park rules and follow all instructions given by your safari guide to ensure safety.

Legal Provisions

**Force Majeure:** We cannot accept liability for compensation where performance is affected by unavoidable events beyond our control, including war, riots, border closure, terrorist activity, extreme weather, disease, or mechanical problems to transport.

**Governing Law:** Matters arising out of your contract with us (the ground operator) will be governed by the **laws of the Republic of Uganda**.

3. Booking, Payments & Logistics

Payments and Deposits

Upon booking, you confirm agreement with these terms and must pay a commitment fee (deposit) determined by your safari consultant. This usually includes **30% of the tour cost** plus the **full price of gorilla permits**. The remaining balance must be paid before the actual start date of your safari.

**Optional Activities:** Costs for optional add-on activities, once determined, can be **added into the total price** or paid **separately**, depending on the timing and nature of the activity.

What is Included and Excluded

  • **INCLUDED:** Accommodation, English-speaking guide, park fees, airport transfers, safari vehicle, ground transportation, gorilla/chimpanzee permits (where appropriate), boat trips, and meals as stated.
  • **EXCLUDED:** Airfare to Africa, entry visa fees, gratitude, airport taxes, personal expenses (drinks, laundry), and accommodation in Kampala/Entebbe/Kigali (which covers bed and breakfast only).
